Retaliatory Notice

A landlord can not evict a tenant in retaliation and nor should they want to.

Retaliatory notice is when a landlord issues a notice to vacate, in retaliation for the tenant trying to enforce their rights, and it's unlawful.

These rights could be anything found in any act but are more often covered by the Residential Tenancies Act.

The penalties for retaliatory notice are pretty steep, at up to $6,500.

Retaliatory notice isn't just unlawful, it's also disruptive to the landlord's cashflow and seldom solves any problems.
